Referral Terms

In these terms and conditions, “you” and “your” means the customer that elects to use our services, and “we” and “us” means Build Assist Pty Ltd.

These terms and conditions set out the basis upon which you utilise the Build Assist service offering. By utilising our services, you agree to the below terms and conditions.

1. Referrals

  1. Upon request, or where we believe beneficial to you, we may introduce you to third parties to provide services to you. Such services may include but are not limited to building, project management, financial advice, finance broking and real estate agency services.
  2. Some third parties that we make introductions to provide us with direct and indirect benefits for making the introduction. We do not otherwise charge you fees for the use of our referral service.
  3. Unless required by law, we are not required to disclose to you the benefit we receive for the making of a referral.
  4. We do not provide any warranty that the services provided by any third parties we refer you to are fit for your requirements. While we use our best endeavours to refer you to a third party that we consider to be an appropriate fit for your stated requirements, it is up to you to ascertain and satisfy yourself that the relevant service providers and the services they offer are fit for your requirements.
  5. We will rely upon any information you provide to us and it is up to you to ensure that any such information is true and correct, and not in any way misleading. We will not take steps to verify the correctness of any information you provide.

2. Third Party Engagements

  1. Build Assist provides a referral service only. We do not provide services other than to introduce you to advisors, building contractors or other third parties that we consider, in our discretion, will benefit you.  We cannot bind a third party to any engagement with you and it is up to you and the third party service provider as to whether to enter into a service agreement or other contractual relationship on terms to be agreed.
  2. We do not otherwise have any affiliation or control over the services provided by such third parties
  3. All third party service providers are engaged by you pursuant to their relevant trading or service terms. All arrangements you make with such third parties are between the respective third party and you directly (Direct Engagement).
  4. With respect to your Direct Engagements, we do not:
    1. get involved in any way with your dealings with one another, they are between each of you only;
    2. accept, receive, guarantee or in any way deal with:
      1. the quality or quantity of services provided;
      2. rates that have been agreed to;
      3. payment terms; or
      4. refunds; and
    3. take responsibility for the actions or omissions of the third part and you hereby hold us harmless and release us from any and all liability arising either directly or indirectly from your Direct Engagements unless caused or contributed to by our negligence in which case we will be responsible to the extent that our negligence contributed to the liability.

3. Privacy

  1. You agree that we may share any information or document you give to us (such as contracts, loan agreements or land contracts) with any referral partner that we elect to refer you to. While we will use reasonable endeavours to only disclose such information we consider appropriate and necessary for the purposes of making a referral to you, we are not bound by any obligation of confidentiality in respect of that information.
  2. You consent to:
    1. the collection of the Personal Information;
    2. the use and disclosure by us of the Personal Information for the purposes of enabling us to make any referral that we consider appropriate, or for any other reasonable purpose in the conduct of our or any related business;
    3. the disclosure to, and use by, real estate agents, marketing consultants, third party contractors, financiers, finance brokers, building contractors and other service contractors or providers of the Personal Information for the purposes of:
      1. enabling Build Assist to comply with and fulfil its obligations under or arising pursuant to or in connection with this Contract; and
      2. procuring the provision to you of the products and services contemplated by this agreement;
      3. such other purposes that Build Assist considers is reasonably ancillary to or complementary to the services being provided by Build Assist.
    4. the use and disclosure by Build Assist of the Personal Information for the purposes of enabling Build Assist to enforce its rights against you or under these terms and conditions; and
    5. the use of the Personal Information for the purposes of marketing or promotion of its business, or such other purpose that we decide from time to time.
  3. The parties acknowledge and agree that the Personal Information will be handled by Build Assist in accordance with the Australian Privacy Principles where applicable to Build Assist.
  4. In this clause Personal Information means information about you given by you to Build Assist before or after you engage with Build Assist in any manner.
